MDE Finalizes 2014 General Stormwater Permit

The Maryland Department of the Environment (MDE) is set to issue the long awaited National Pollutant Discharge Elimination (NPDES) 2014 General Permit for Stormwater Associated with Construction Activity (General Permit) with an effective date of January 1, 2015. The 2014 general permit lasts for a term of five years and will expire December 31, 2019. Coverage under the current 2009 general permit will be terminated December 31, 2014.

Bald Eagle Surveys

The Bald Eagle nesting season is almost upon us, and with it, a reminder that, when present, active nests carry a list of restricted activities that may or may not be performed within a specific distance of the nest. If you are planning on developing land near a bald eagle nest, you need to be aware of these restrictions and obtain the proper permits, if necessary.

Virginia Stormwater Management Act Triggers Changes

Revisions to the Virginia Stormwater Management Act in 2014 require localities in Tidewater Virginia subject to the Chesapeake Bay Preservation Act (CBPA) to adopt requirements to regulate “CBPA land-disturbing activities.” In addition, the CBPA was amended to allow additional parties to certify that a septic system is functioning properly.

Updated Fairfax County Chesapeake Bay Preservation Ordinance

Recently effective updates to Chapter 118 of the Fairfax County Code (a.k.a., the Chesapeake Bay Preservation Ordinance) have wrought some significant changes. While primarily bringing the Ordinance in-line with the new state stormwater regulations, significant changes to definitions and allowed uses were also made, affecting requirements for development, redevelopment, and stormwater facilities.

Proposed DEQ Prospectus for the In-Lieu-Fee (ILF) Program

In September 2014, the Virginia Department of Environmental Quality (DEQ) submitted to the U.S. Army Corps of Engineers (COE), Norfolk District Regulatory Branch, a Prospectus for a Wetland and Stream Replacement Fund In-Lieu Fee Mitigation Program that will address projects throughout the Commonwealth of Virginia and in all watersheds.
